judicial despr\u00e9s de la sent\u00e8ncia del Tribunal Suprem, que confirma que les empreses no poden retallar la retribuci\u00f3 variable per incapacitat temporal ni per permisos retribu\u00efts.<\/strong><\/em><\/em><\/p>\n<\/div>\n\n\n\n<p>En aquest procediment, <strong>CCOO ha participat activament<\/strong> <strong>en el litigi juntament amb UGT<\/strong>, <strong>reafirmant el nostre comprom\u00eds<\/strong> en la defensa dels drets de la plantilla <strong>fins a les \u00faltimes conseq\u00fc\u00e8ncies.<\/strong><\/p>\n\n\n\n<p>El Tribunal Suprem, en la seva <strong>Sent\u00e8ncia n\u00fam. 35\/2026,<\/strong> de 16 de gener de 2026, declara nul\u00b7la la pr\u00e0ctica empresarial de descomptar del c\u00e0lcul de l&#8217;incentiu els dies no treballats per <strong>IT o per permisos retribu\u00efts<\/strong>, en tractar-se d&#8217;un sistema basat en <strong>\u201cjornades productives\u201d<\/strong> implantat unilateralment per l&#8217;empresa <strong>Ayesa Iberm\u00e1tica S.A.U<\/strong>.<\/p>\n\n\n\n<p class=\"has-large-font-size\"> <strong>Paral\u00b7lelismes amb models retributius com el de CaixaBank<\/strong> <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"margin-top:var(--wp--preset--spacing--20);margin-bottom:var(--wp--preset--spacing--20)\"> <strong>Sistema de retribuci\u00f3 variable<\/strong> basat en criteris interns de \u201cproductivitat\u201d. <\/li>\n\n\n\n<li style=\"margin-top:var(--wp--preset--spacing--20);margin-bottom:var(--wp--preset--spacing--20)\"> <strong>Model implantat unilateralment<\/strong> per l&#8217;empresa, sense negociaci\u00f3 col\u00b7lectiva. <\/li>\n\n\n\n<li style=\"margin-top:var(--wp--preset--spacing--20);margin-bottom:var(--wp--preset--spacing--20)\"><strong>Exclusi\u00f3 de dies d&#8217;IT i permisos retribu\u00efts<\/strong> del c\u00e0lcul de l&#8217;incentiu.<\/li>\n<\/ul>\n\n\n\n<p> Des de CCOO considerem que aquesta sent\u00e8ncia fixa un criteri clar i plenament aplicable als models de retribuci\u00f3 variable com el de CaixaBank.<\/p>\n\n\n\n<p> Per aix\u00f2, <strong>instem a la direcci\u00f3 a negociar de forma immediata<\/strong> un acord que garanteixi que: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"margin-top:var(--wp--preset--spacing--20);margin-bottom:var(--wp--preset--spacing--20)\">La IT <strong>no impliqui retallades<\/strong> en la retribuci\u00f3 variable.<\/li>\n\n\n\n<li style=\"margin-top:var(--wp--preset--spacing--20);margin-bottom:var(--wp--preset--spacing--20)\"> Els permisos retribu\u00efts <strong>no es tradueixin en penalitzacions salarials<\/strong> . <\/li>\n\n\n\n<li style=\"margin-top:var(--wp--preset--spacing--20);margin-bottom:var(--wp--preset--spacing--20)\"> S&#8217;eliminen <strong>criteris unilaterals<\/strong> que converteixen drets en
